1. Acceptance of Terms

Use of the Bam! service implies full acceptance of these Terms and Conditions. By accessing the platform, whether through the web or desktop application, the user declares to have read, understood and accepted all conditions described herein.

The service is offered by Bam!. If the user does not intend to accept these terms, they are asked not to use the service.

2. Service Description

Bam! is a file sharing platform that enables secure file transfer via cloud streaming. Files are split into encrypted chunks, uploaded to Cloudflare R2, and each chunk is deleted immediately after download.

The service is available as a browser-accessible web application. A desktop application via Electron for Windows, macOS and Linux is currently in development (coming soon).

3. Account & Registration

Bam! offers three levels of usage:

• Anonymous (Guest) — No registration required. The user can use the service immediately with basic features.
• Pro Free — Requires free registration via email or OAuth authentication (Google, GitHub). Offers additional features such as download resume.
• Pro Premium — Requires a paid subscription. Includes all advanced features without limitations and without advertising.

The user is responsible for the security of their login credentials and all activities carried out through their account.

4. Usage Limits

Usage limits vary based on account level:

• Anonymous and Pro Free: maximum 5 file transfers per day.
• Pro Premium: unlimited file transfers.
• File size: unlimited for all account levels.

5. Acceptable Use

The user agrees not to use Bam! for the following activities:

• Sharing illegal content or content that violates applicable laws.
• Distributing malware, viruses, trojans or any harmful software.
• Sharing copyrighted material without the rights holder's authorization.
• Spreading unlawful, defamatory, offensive or hate-inciting content.
• Any activity aimed at compromising platform security or operation.

6. Intellectual Property

The Bam! brand, source code, interface design and all original platform content are the exclusive property of the Bam! team and are protected by applicable intellectual property laws.

The user retains full ownership of files shared through the platform. Bam! claims no rights over content transferred by users.

7. Encryption & Security

All transfers on Bam! are protected by native end-to-end encryption (E2EE), guaranteed by TLS 1.3 over HTTPS for all data in transit, and optionally by AES-GCM encryption for chunk content (Premium). Data in transit cannot be intercepted by third parties.

• Optional AES-GCM encryption: available for Pro Premium users, allows adding an extra layer of protection via password with PBKDF2 key derivation.
• Integrity verification: xxHash128 hash to ensure received files are identical to those sent.

8. Limitation of Liability

The Bam! service is provided "as-is", without warranties of any kind, express or implied.

• Bam! does not guarantee continuous and uninterrupted service uptime.
• Bam! is not responsible for any data loss during file transfer.
• Bam! is not responsible for direct or indirect damages resulting from service use.
• Transfer quality depends on the users' internet connections and factors outside Bam!'s control.

9. Changes to Terms

Bam! reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective from the date of publication on the platform.

Registered users (Pro Free and Pro Premium) will be notified via email in case of material changes to the terms of service. Continued use of the service after publication of changes constitutes acceptance of the new terms.

10. Applicable Law

These Terms and Conditions are governed by Italian law. For any dispute arising from the interpretation or execution of these terms, the competent Italian court with territorial jurisdiction shall have exclusive jurisdiction.
